Reference to the Act on Higher Education and Science of 20 July 2018
In the Polish legal system, postgraduate studies – including MBA, EMBA and DBA programmes – are a form of continuing education and not studies leading to a professional title (bachelor, master, engineer) or an academic degree (doctor). They are regulated by the Act on Higher Education and Science of 20 July 2018, in particular Articles 160–164.
Art. 160 sets out the basic requirements: postgraduate studies must last at least 2 semesters, comprise a minimum of 30 ECTS and lead to partial qualifications at levels 6–8 of the Polish Qualifications Framework. They are not part of the degree path but an element of continuing education.
Art. 163 indicates the entities authorised to run postgraduate studies (universities, research institutes, the Polish Academy of Sciences, CMKP) and confirms their fee-based nature. Art. 164 sets out the rules for issuing certificates – documents confirming completion of postgraduate studies.
The names MBA, EMBA or DBA are programme or marketing designations but do not create any separate legal category. Under the Act they are ordinary postgraduate studies that do not confer new professional titles or academic degrees – they end with a certificate confirming the qualifications obtained.
